Set Phasers to Litigate

Over at Huffington Post, I have an update on Terrance Huff, the filmmaker who was pulled over and searched in Collinsville, Illinois while returning from a Star Trek convention last year.

He filed a civil rights lawsuit this morning.

    Tidbit at the end: Ill. State Attorney said it was all kosher because, and get this, Huff had a drug arrest (no conviction) in the past and therefore, probable cause. Is it just me or is that theory of PC totally absurd? If you ever get caught it their web, well you’re ….ed.

    The video is amazing in demonstrating what modern day pirates
    these traffic cops are. Fabricated probable cause on top
    of a fabricated drug problem on top of manufactured probable cause.
    In other words, bullshit piled on top of horseshit sprinkled with
    chickenshit, just for driving down the road in the so-called “Land of the Free.” I hope Reichert’s career goes down in flames: he messed with the wrong nerd.

    I am really glad to see all the people come out in support of Huff, against the officer, and hope that Huff refuses to settle. Interesting how all these people came forward through publication of the lawsuit, but I will bet that the local PD refuses requests for the personel files.

    A previous arrest is never probable cause of criminal wrongdoing on it’s own. Officers always need independent probable cause (or reasonable suspicion) based on the circumstances of that particular incident.

    The state is either posturing or horrifically ignorant . Any attorney worth a damn will laugh at them.

    Rule #1 for bullies: Only pick on defenseless victims. The officer’s error was stopping someone with the ability to fight back.

    I’d have done it slightly differently. May or may not have worked, but:

    Am I free to go?
    Yes.
    (Start walking back to car)
    Mind if I ask you a few quick questions?
    (Do not respond in any way, keep walking, get in car and drive away)

    I don’t think folks are making enough of that “previous arrest.” According to Huff, it was supposed to be wiped off his record, and yet there it stands. Kinda weird how the justice system can be so assiduous in its efforts on one end and so lax on the other.

    Referring to the way Reichert instructed his drug-sniffing dog in the Huff video, Williams told the paper, “While some people may think it’s distasteful, it’s clearly not illegal.”

    Williams added, “Everything that we do is vetted through current law or Supreme Court rulings.”

    CSP: No, it means “we use the lowest possible standard for legality.” It’s no surprise they would dip below that line when they’re already intentionally skirting it.

    April 2011 Officer of the Month

    I would like to congratulate Officer Michael Reichert for being named Officer of the Month for April 2011. Sergeant Chuck Mackin nominated him for this award.
    Officer Reichert continually reflects the proactive and innovative philosophy of law enforcement followed by the Collinsville Police Department. He has demonstrated this by his aggressive approach to drug trafficking in the area.
    Officer Reichert had 166 total incidents with 6 arrests and 7 citations in 13 working days. In addition to this he had 3 self initiated significant incidents that are very worthy of praise.
    On 4-15-11 Officer Mike Reichert was performing proactive drug interdiction at Fed Ex and discovered a suspicious package. The package contained two pounds of cannabis. A controlled delivery was initiated with the assistance of another agency and the package was delivered to a Madison County address where two suspects were arrested and charged with Unlawful Possession with Intent to Deliver Cannabis.
    Again on 4-21-11 Officer Reichert was at Fed Ex again and discovered another suspicious package. The package contained two pounds of cannabis. Another controlled delivery was initiated by the Collinsville Police Department. The Package was delivered locally and this time three suspects were charged with Unlawful Possession with Intent to Deliver Cannabis.
    Astonishingly on 4-26-11 Officer Reichert again discovered a suspicious package while at Fed Ex. The package contained one pound of cannabis. An investigation was opened and two suspects identified. Charges are pending against the two suspects.
    Officer Reichert is very deserving of recognition for his diligent work this past month and I again congratulate him for being chosen as Officer of the Month for April 2011.

    OT but here is a GA cop who apparently admits to kicking a pregnant woman in the stomach during a dispute. Also looks like he previously went to a wrong address and shot the dog there.
