I tend to agree, but it&#039;s not as clear cut as I thought.  The argument against judging the law calls into question the right of 12 people on the jury to override a law that was enacted by a legislature that was elected by &lt;i&gt;all&lt;/i&gt; the people.  

I would be inclined to permit the defense to pursue whatever argument they want.  The state can then refute the argument, telling the jury that even a bad law doesn&#039;t justify murder.  I think the likelihood of someone being on the jury that would actually support the killing of doctors would be very small (especially if they were screened out during voir dire).</description>
