I tend to agree, but it’s not as clear cut as I thought. The argument against judging the law calls into question the right of 12 people on the jury to override a law that was enacted by a legislature that was elected by all the people.

I would be inclined to permit the defense to pursue whatever argument they want. The state can then refute the argument, telling the jury that even a bad law doesn’t justify murder. I think the likelihood of someone being on the jury that would actually support the killing of doctors would be very small (especially if they were screened out during voir dire).

If you think you can make fun of the Left as well as Stewart makes fun of the Right, then have at it. You have every opportunity.

Even when making a political point, the first thing a satirist must do is be funny. Without the humor you’re just another ranting fool, regardless of what you’re saying. Stewart realizes that, while the right-wingers that have tried it thus far don’t.

Here’s the way I see it. If nude modeling were a requirement for Congress, we would probably not attract many candidates with brains, but we might get some with looks. For the most part, we’re not getting much of either right now.

I agree with you in principle that a jury has a right to be fully informed. However, there probably does need to be some control over what is entered. If this makes you feel any better, and as a disclaimer I don’t know the case fully, I imagine the Judge is saying that the jury instructions won’t include a self-defense (defense of others) instruction, but he could still take the stand and say “Yeah, I killed the sonofabitch because he’s an abortion doctor.” So, jury nullification is still viable here, but it’ll have to be true nullification as opposed to a finding of self-defense.
