Federal Court Restricts Taser Use –

God Bless Judicial Activism, mofos.
You do great stuff with lights.
There are a couple of documents to read in the Jonathan Ayers case. First, the letter from Daniel Porter, the Gwinnett County DA who was brought in to help on the case, to Brian Rickman, the DA who was otherwise the main state actor.

There are a few interesting tidbits in here, one being that the car didn’t actually hit the officer. Instead, he put his hands on the trunk and pushed off it to jump out of the way. He also gives a good narrative of the relevant things that transpired that day leading up to the shooting.
His legal analysis, while good, is still sadly lacking. He does have this in there:
That’s why it went to a GJ.
The problem, again, is that this situation – where Ayers feared for his life – was created solely by the actions of these officers. Given this situation, Porter says that the shooting was justified. He fails to consider that they created the situation which he then uses to justify the shooting.
Put another way, had these not been police officers, I *highly* doubt he would have reached the same conclusion. Note that his analysis technically has nothing to do with their being police officers.
Another good story put out today:
http://www.thenortheastgeorgian.com/articles/2009/12/29/news/top_stories/01topstory.txt
Talking to people who overheard Ayers being questioned in the hospital, he repeatedly told investigators that he thought he was being robbed.
That’s Ayers’ view of it. Two guys jumped out of a dark vehicle and started waving guns at him. Who the hell wouldn’t drive off in that circumstance?
Another:
Note no mention of “he said he was a police officer”.
I just hope to God that these guys no longer have their little “dress up and play drug police” thing going on.
Dang Radley! That place looks depressing as hell. I would not have wanted to be stuck there either.
That must have been one horrible and unexpected stay but you certainly got some fantastic pictures out of it.
And I’m very sorry to hear about Harper.
