I don’t see how this ruling stands in light of Raich, but its encouraging to at least see a sitting judge mention the 10th Amendment. (NOTE: This post amended–the suit was brought in federal court, not state court.)

Regarding the saggy pants, I don’t see how such a law could be constitutional, even under the rational basis test: “rationally related to a legitimate governmental interest.” Fashion has never been a legitimate governmental interest. I also notice that this was only in a bail hearing, so the whole case has a long way to go before becoming anything you can sink your teeth into.
Regarding Raich, medical marijuana, and the 10th Amendment, the 10th was never brought up in Raich, so while this ruling doesn’t agree with Raich, it doesn’t disagree with it either. Courts only rule on the issues that are brought before them. Thus, Raich saying that the feds are not violating the Commerce Clause does not mean that they are not violating the 10th. This one will have to work its way through the court system, too (though, to get the USSC involved, it’ll have to go up the state court system, to the Cal. Supreme Court, and then appealed from there).

A point of order, the Santa Cruz case was brought in Federal Court. I haven’t read the plaintiff’s Second Amended Complaint (though it is available here http://www.aclu.org/drugpolicy/medmarijuana/32959lgl20071128.html). However, the significance of the judge’s ruling is this: if everything alleged by the plaintiffs in the complaint is true, the plaintiffs are entitled to the relief requested.

The saggy pants fad surfaced in jail, when juvenile offenders wore overly large prison garb that sagged, exposing their underwear. It later became a fashion statement among rappers and remains popular in urban communities across the country.
I was listening to NPR a while back, and the man behind making baggy pants into a state ban justified it by the fact that the kids didn’t “realize” that baggy pants was a symbol of being a homosexual prison bitch.
Which is wrong on at least two senses of the word.

Regarding the baggy pants law, it is undeniable that it unconstitutional. What is worrying me is how many ignorant suburban voters will approve, and fight for it. These are the same people who have no problem with racial profiling, police brutality, and the removal of the fourth ammendment, as long as it doesn’t inconvenience them.
What does the future hold for the constitution and liberty in a world where voters (and Supreme Court justices) are composed of these types?

It’s ironic that you’d post that story questioning Georgia’s victimhood when just the other day, Georgia released military intelligence that all but proves that the Russians invaded South Ossetia before the shelling of Tskhinvali began.
Don’t get me wrong – I’m not supporting more US involvement or anything – I’m just saying that as a libertarian, you should be more skeptical of all governments, not just American allies.

Constitutions are cool. They can mean all things to everybody.
You say this as if this were a new phenomenon. Seriously, we’ve had this problem for 230 years in this country, it’s a continual battle. The main ways to combat it are education and breaking up group-think where possible.
Regarding the wrongfully convicted guy, the article lists a bunch of ways in which he thinks the justice system could be improved. The one thing missing which I’ve always thought was terrible is plea bargaining. For the actually-guilty plea bargaining is a good thing, and plea bargaining by the actually-guilty can be good for society as it encourages them to report other criminals in exchange for a reduced sentence.
But for the innocent, plea bargaining presents a terrible choice. Confess to a crime you didn’t commit to avoid the full sentence? Fight a charge for which you are innocent, and possibly face a longer sentence because of your refusal to express remorse?

I’m with you on the plea bargaining. It should properly be callled plea blackmail. Plead guilty to crime “A” and get sentence “Z”. Refuse the offer and be charged with the more serious crime “B” with harsher sentence “Y”. Some bargaining.
In my mind “plea bargaining” should either be banned, or at the very least, prosecutors should only be allowed to charge a defendant with whatever was offered by the prosecutor during a plea negotiation. IOW, if the D.A is willing to accept a plea from the defendant for crime “A” without a trial, he should only be allowed to go to trial charging crime “A” if the plea is rejected by the defendant.
If these rules where in place, the authorities would be forced to re-priortize their efforts which might hasten an end to the injustice known as the WOD.
