Legal Help Needed
Thursday, November 15th, 2007I’m writing about a terrible case in Louisiana in which a family was wrongfully convicted of a drug conspiracy, and did three months in prison before being released. The charges against them have been since been dropped.
This was a federal case that dragged on for more than five years. It emptied the already-working class family’s finances. It’s really a heartbreaking story.
The family is now looking to file a federal Section 1983 lawsuit, but their window to file is rapidly closing. They have about a month. Legal experts I’ve talked to say the case is a long shot, and would probably set some precedent if it even made it past summary judgment. But they also say it’s not impossible. There’s no question that an injustice was done to the family. There’s also no question (at least in my mind) that the prosecutor in the case behaved poorly. The question is if federal law allows him to be held accountable, and for the family to be compensated. So far, they’ve been unable to find someone in-state to represent them.
