Save What’s Left of the Flag for Me

Crazy story from Asheville, North Carolina, where a couple alleges they were roughed up by a police officer for displaying an upside-down American flag, then refusing to show him ID. The cop says the hippie couple started the ruckus.

Believe who you will. It’s this part that I find puzzling:

Sorrells said this is the first time he has seen the flag-desecration law enforced. He said it’s a difficult decision for an officer to weigh a resident’s right to free speech against another’s complaint of a law violation.

Didn’t the U.S. Supreme Court rule about 20 years ago that flag desecration laws were unconstitutional? How is this law still on the books? What am I missing, here?
