He’s Right. So Shut Him Up.

Via To the People, Judge Royce Lamberth has rightly excoriated the federal government for the way it has mishandled the trust fund set up for Native Americans. Even the appellate court that oversees his district agrees.

Unfortunately, Lamberth has told the government as much. In appropriately incendiary language (the appellate court agrees with most of the language, too). Nevertheless, the appellate court has since removed Lamberth from the dispute between Native Americans and the feds, because, it says, he is too “biased against the government.”

If he’s right, where’s the bias? Also, has a judge ever been removed from a case for being “too deferential to government?” Think it could ever happen?

Me neither.
