Alito and No-Knock Raids

Sunday, January 15th, 2006

Here’s the only case on Alito and no-knocks I could find.

A family of four visits a relative just as police are conducting a no-knock on the relative’s apartment. The family — comletely innocent — is forced to the ground at gunpoint, detained and searched. The family sues.

The district court wouldn’t even let the suit get to trial, dismissing it at summary judgment. The Third Circuit Court of Appeals reversed, letting the family file a claim.

Alito, as you might have guessed, dissented.
