…who killed federalism. Hypocrite. He did write a concurring opinion, so it’ll be interesting to see how he wriggled out from under Lopez.

Kennedy also voted for federalism in Lopez and Morrison, but for federal power in Raich.

All four liberal justices voted with Ashcroft (now switched to Gonzalez). Statists and fascists unite!
