Warning: State Regulators May Waste Taxpayer Dollars With Frivolous Lawsuits
Sunday, May 30th, 2004It’s not online yet, but the latest member newsletter from the National Association of Manufacturers includes the following gem:
A liability lawsuit cooked up by the state of New Jersey against Nissan would require a manufacturer to including a warning that says: “WARNING: THIEVES MIGHT STEAL THIS PRODUCT.The cause of this insanity? Nissan’s popular blue-tinged xenon headlights.
Apparently , the headlights of the Nissan Maxima have become a popular target for thieves who rip them from cars and sell them on the black market. There’s no defect in the xenon headlights, and there’s no law requiring warnings about the possibility that a car or its parts might be stolen. But the state insists on regulation by litigation.
Because who knows how many consumers would have been dissuaded from buying a Nissan had they only popped out the headlights and seen that warning label before driving off the lot?

Some plucky group should respond with a lawsuit against NJ requiring warnings on government publications/checks/ballots/etc. It’s too late at night for me to come up with a clever warning they should suggest, but I’m sure someone can oblige. Too bad it’s not the feds, or the suit could be about placing the exact same warning on money…
Unfortunately, there’s always the problem that you’ll be suing the state in their court, with their employees working as judge, etc. Sure, sometimes people win, but the general trend is clearly towards favoring the state.
Along the same lines as cyclo. . . how about such warnings on purses, pocketbooks, wallets and handbags. Surely laptops and pdas and – oh yeah – guns, shouls have warnings, too.
Someone stop the insanity!
This will surely make that list of stupid disclaimers that comes out every year…like the one that said “if you cannot read this, do not use this product”. Or the one on a smoke detector that proclaimed that the product could not put out fires.
At birth, doctors should be required, by law, to put a tattoo on our genitalia that reads “WARNING: USE MAY CAUSE UNWANTED DISEASES AND OFFSPRING. USE AT YOUR OWN RISK”. Or how about a warning on everything, EVERY SINGLE PRODUCT produced by mankind, that reads “incorrect use may result in injury or death”.
Awwwwww, FUCK! These bastards make my head hurt.
