More Fourth Amendment Tomfoolery
Sunday, March 28th, 2004Damn. I just posted on the Fourth Amendment. I can’t go to the gym for two hours before the Bill of Rights takes another hit.
A federal appeals court has opened the door for police officers in three states to search homes and buildings for evidence without a warrant — a ruling that two dissenting judges called “the road to hell.”Acting on a Baton Rouge case, the 5th U.S. Circuit Court of Appeals ruled that police do not need an arrest or search warrant to conduct a swift sweep of private property to ensure their own safety.
Any evidence discovered during that search now is admissible in court as long as the search is a “cursory inspection,” and if police entered the site for a legitimate law enforcement purpose and believed it may be dangerous.

My favorite response comes in another article, from New Orleans police department spokesman Capt. Marlon Defillo, who promised the new power “won’t be abused.”
Lessee. Spokesperson for the most corrupt major city police department in the country promises that a sweeping new power to search without warrants won’t be abused.

Private property rights under attack with governments stealing homes for new Wal-Marts. Freedom of Speech rights under attack from the politically correct crowd, not to mention campaign finance reform, Freedom of Assembly [and speech] is under attack from the so called Free Speech zones created where ever the president goes so he isnt “threatened” by protesters, yet his supporters are right there on the sidelines. I know this is off-topic, but I don’t know where else to post these comments… anyone here know that Kerry spent his summers in a family home in France and that he attended boarding school in Switzerland??? How in the world does this make him relatable to the “poor” people he is pandering to in this election? Sorry for the rant. I didn’t know where else to go. This is probably old news but it’s new to me.
As a Louisiana resident, I’d like to first point out that the article that the AP did gives more detail on the case, and also the full quote from the dissenting judges, and reminds residents of Mississippi and Texas that they are also affected by this ruling.

It’s fabulous to know that after a 10 year justice department investigation, the prevailing corruption in the NOPD has been overcome so they won’t misuse this new power.

Yes, that seems to be off topic. However I reread the post and I didnât find a single reference to Bush. Rather than just pointing out the facts in Mr. Kerry’s residence your decided to make it a clearly partisan rant, thereby negating your case. Nice job.

You are right however, I did take a snotty tone for this I apologize to you and Ms. Dani. But my arguement still applies, it goes both ways in the snipeing game, pro-bush voters tend to get riled up when someone says his hair looks bad, just as pro-kerry voters get riled up when you talk about botox injections. heehee. The thing is Michael is that it’s the Democrats who generally like to make a big deal about someone being a blue’blood, or in Kerry’s case would that be a “bleu”-blood? Suddenly we’re not hearing those comments this time around? Wonder why?

A “protective sweep” search of a residence has long been established as an exception to the warrant rule, but it appears here that the slope has slippened.
