Wednesday, June 18th, 2003Here’s Andrew Sullivan on Stanley Kurtz’s silly “gay people will corrupt the institution of marriage” argument:
Let’s say that the gay presence in the population is 3 percent. Let’s say that marriage will be half as likely for gays as straights. Out of 1000 marriages, around 15 are therefore likely to be same-sex. Of those fifteen, ten will probably be lesbian. What Stanley Kurtz is trying to argue is that 5 gay male marriages are more likely to affect the 9,995 other marriages than the other way round. To put it politely, this is highly implausible. The almost certain effect of same-sex marriage will be to mainstream gays, not radicalize straights. Only the truly paranoid could think otherwise. Yet Kurtz and others would actually doctor the U.S. Constitution to prevent this tiny conservative social reform from happening.
It’s a good point, save for the “conservative” part. Sorry Sully, but because you say it is doesn’t make it so. If “conservative” means conserving that status quo, you really can’t convincingly make the case that gay marriage is conservative.
As I’ve written before (and will write in my Fox column tomorrow), both sides are having the wrong debate. Marriage is far too personal, intimate and private an act for state involvement. Get the state out of the way, and the issue resolves itself. You form “marriage contracts” with whomever you please, and the state steps in only to enforce them if/when someone’s in breach.

My husband and I were trying to debate the subject of same-sex marriages. We came to the conclusion that the legal ban is in jeopardy because the only reason lawmakers can give for the ban is based on religion. It has been made into a “victimless crime” in our country. There is no real reason other than relgion to ban same-sex marriages.
Both of my husbands think it’s ok too.
If they do outlaw same-sex marriages, they might be in jeapordy of changing the implementation of marriage today.
If they only use religon as the argument against same sex marriage, then someone will strike down the law on the basis of the separation of the church and state.
The ruling COULD (if broad enough) strike down the notion of a ‘marriage license’ granted by the state. Remember that Marriage is considered a Holy Sacrement by many religons. Since my Confirmation, I have always found it rather offensive that the state has to grant you a license in order to take part in a Holy Sacrement. Consider if you had to get permission in order to take Communion.
So in a way I hope they do pass the law, simply so it can be struck down in a manner that will remove the state from regulating a Holy Sacrement. Call it a ‘Contract for civil union’ (or whatever) and leave Marriage to religon. Then if you are against same-sex marriages, then make sure that you belong to a religon that shares your beliefs.
